Anne Arundel County’s Housing Attainability Act, enacted in 2024 and effective July 1, 2025, creates the Moderately Priced Dwelling Unit Program (“MPDU Program”), which requires that all new development in the County with 10 or more units (with the exception of development in the RA-Rural Agricultural and RLD-Residential Low Density districts) contain a certain percentage of moderately priced dwelling units (“MPDUs”). A copy of the Housing Attainability Act can be accessed here.
Rental developments are required to reserve fifteen percent (15%) of total units as MPDUs for households earning 75% or below of the Area Median Income (“AMI”), adjusted for household size, for a period of 40 years.
For-sale developments are required to reserve ten (10%) of total units as MPDUs for households earning 100% or below of the AMI, adjusted for household size, for a period of 20 years, provided that the purchase price will be set based on a household earning 80% of AMI as set forth in more detail in the MPDU For Sale Income and Sales Price Requirements (linked below).
Arundel Community Development Services, Inc. (“ACDS”) will administer the MPDU Program in conjunction with the County. ACDS has created the following policies, procedures and documents to provide more detail, as authorized by the Housing Attainability Act, in the operation and administration of the MPDU Program, with additional documents related to waiting lists and leasing guidelines to be provided in the coming months.
NOTE: While the MPDU Program is effective as of July 1, 2025, the first units will not be available for purchase or rent until new developments are complete, which is expected to be approximately 24 months after the effective date. ACDS will be posting additional information here regarding the opening of waiting lists and the availability of units. Households interested in renting or purchasing an MPDU unit are encouraged to monitor this website for updates on the opening of the waiting lists and availability of units.
